Privacy Policy

Internap Holding LLC, together with its affiliates and subsidiaries (“HorizonIQ”, “we”, “us” or “our”) respect your privacy and seek to protect the information that we collect, receive, store and process in connection with your use of the Services. This Privacy Policy (the “Policy”) describes the ways that we collect, process and otherwise use your information and data in connection with the Services and/or through your use of our website, horizoniq.com, and any other websites, online features, applications and widgets owned or controlled by HorizonIQ (collectively and together with any subdomains and content and services therein, the “Site”). For purposes of this Policy, HorizonIQ’s Services and the Site are collectively referred to as the “Services.”

Please review this Policy carefully to understand our practices regarding your information and how we will treat it. If you do not agree with our policies and practices as set forth in this Policy, then please do not use our Services. This Policy may change from time to time (see “Changes to this Policy”). Your continued use of our Services after we make changes is deemed to be acceptance of those changes, so please check the Policy periodically for updates.

Information We Collect

Information You Provide to Us

We collect information you provide directly to us. For example, you share information directly with us when you create an account and/or purchase any of our Services, submit content through our Services, participate in a contest or promotion, request customer support, or otherwise communicate with us. To ensure that we provide you with the best possible experience, we will store, use, and disclose Personal Information about you in accordance with this Policy. As used herein, “Personal Information” is information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular user or individual. The types of Personal Information we may collect include your name, email address, postal address, phone number, credit card and other payment information, and any other information you choose to provide.

We may provide you the opportunity to participate and post content publicly through interactive features. You may choose, through such features or otherwise, to submit or post reviews, comments, or suggestions related to HorizonIQ’s Services, or post free-form comments (collectively, “User Content”). Please note that certain information, such as your name and state of residence, and a link to any website URL you provide may be publicly displayed along with your User Content. Note that any User Content you post is public and that others will have access to such User Content and may read it, see it, use it, and/or share it with third parties. If you disclose Personal Information in your User Content, that information will be considered public information and the protections of this Policy will not apply.

Information We Collect Automatically When You Interact with Us

When you access or use our Services or otherwise transact business with us, we automatically collect certain information, including, but not limited to:

  • Activity Information: we collect information about your activity on our Services, such as items you look at on our website, session recordings, and other activity on our Services.
  • Transactional Information: when you make a purchase or enter into a contract with us, we collect information about the transaction, such as details of the Services, purchase price, term of contract, and the date and location of the transaction.
  • Device and Usage Information: we collect information about how you access our Services, including data about the device and network you use, such as your hardware model, operating system version, mobile network, IP address, unique device identifiers, browser type, and app version. We may also collect information about your activity on our Services, such as access times, pages viewed, links clicked, and the page you visited before navigating to our Services.

  • Information Collected by Cookies and Similar Tracking Technologies: we (and our service providers) use tracking technologies, such as cookies and web beacons, to collect information about you. Cookies are small data files stored on your hard drive or in device memory that help us improve our Services and your experience, see which areas and features of our Services are popular, and count visits. Web beacons (also known as “pixel tags” or “clear GIFs”) are electronic images that we use on our Services and in our emails to help deliver cookies, count visits, and understand usage and campaign effectiveness (such as opening of emails, forwarding of emails, clicking of links, and time, date, and frequency of activity).

We may use such information for a variety of purposes, including enhancing or otherwise improving the Services. We may associate this information with you as a specific and identifiable person. When we do so, we treat the combined information as Personal Information.

Notwithstanding the generality of any of the above, we may collect the following types and categories of information from users of the Services and use or disclose such information for our legitimate business purposes:

Email Interconnectivity If you receive email from us, we may use certain tools to capture data related to when you open or interact with our messages. We have a legitimate interest in understanding how you interact with our communications to you.
Employment If you apply for a job posting, or become an employee, we collect information necessary to process your application or to retain you as an employee. This may include, among other things, your Social Security Number. Providing this information is required for employment. We use information about current employees to perform our contract of employment, or the anticipation of a contract of employment with you. In some contexts, we are also required by law to collect information about our employees. We also have a legitimate interest in using your information to have efficient staffing and work force operations.
Feedback/Support If you provide us feedback or contact us for support we will collect your name and e-mail address, as well as any other content that you send to us, in order to reply. We have a legitimate interest in receiving, and acting upon, your feedback or issues.
Mailing List When you sign up for one of our mailing lists we collect your email address or postal address. We share information about our products and services with individuals that consent to receive such information. We have a legitimate interest in sharing information about our products or services.
Online Registration We collect your name and contact information when you create an online account. We also collect information relating to the actions that you perform while logged into your account. We have a legitimate interest in providing account relating functionalities to our users.
Surveys When you participate in a survey we collect information that you provide through the survey. If the survey is provided by a third party service provider, the third party’s privacy policy applies to the collection, use, and disclosure of your information. We have a legitimate interest in understanding your opinions, and collecting information relevant to our organization.
Web logs We collect information, including your browser type, operating system, Internet Protocol (IP) address (a number that is automatically assigned to a computer when the Internet is used), domain name, click-activity, referring website, and/or a date/time stamp for visitors. We have a legitimate interest in monitoring our networks and the visitors to our websites.

Information We Collect from Other Sources

We may also receive information about you from third parties. For example, if you are on another website that provides information about service providers like HorizonIQ and you request to receive information from HorizonIQ, that website will forward your contact and other information to us so that we may contact you as requested. Third parties may also provide information about you in connection with a marketing arrangement we may have with those third parties.

Information We Derive

We may derive information or draw inferences about you based on the information we collect. For example, we may make inferences about your location based on your IP address or infer that you are looking to purchase certain services based on your browsing behavior and past purchases.

Use of Information

We use the information we collect to provide, maintain, and improve our Services. We also use the information we collect to:

  • Process transactions and send you related information, including confirmations, receipts, invoices, customer experience surveys, and related communications;
  • Send you technical notices, security alerts, and support and administrative messages;
  • Provide customer service;
  • Communicate with you about the Services offered by HorizonIQ and provide news and information that we think will interest you;
  • Monitor and analyze trends, usage, and activities in connection with our Services;
  • Personalize the advertisements you see on third-party platforms and websites;
  • Personalize the advertisements you see when you use our Services based on information provided by our advertising partners;
  • Facilitate contests, sweepstakes, and promotions and process and deliver entries and rewards;
  • Detect, investigate, and prevent security incidents and other malicious, deceptive, fraudulent, or illegal activity and protect the rights and property of HorizonIQ and others;
  • Debug to identify and repair errors in our Services;
  • Comply with our legal and financial obligations; and
  • Carry out any other purpose described to you at the time the information was collected.

The length of time HorizonIQ intends to retain Personal Information, including sensitive personal information, if any, is for as long as reasonably necessary to perform the intended business purpose for such information.

Use of Cookies

We cookies to better your experience while visiting the Site. A cookie is a small amount of data, which may include a unique identifier that track, save, and store information about the user’s interactions and usage of the website. This allows the website, through its server, to provide the users with a tailored experience within this website. Cookies are sent to your browser from a website and stored on your device. We assign a different cookie to each device that accesses our Site.

Other cookies may be stored to your computer’s hard drive by external vendors when this website uses referral programs, sponsored links, or adverts. Such cookies are used for conversion and referral tracking and typically expire after 30 days, though some may take longer. We work with a number of third party services to ensure your experience with HorizonIQ is optimal. All relevant third parties have their own privacy policies.

Disclosure of Information

We disclose your information, including Personal Information, in the following circumstances or as otherwise described in this Policy:

  • We disclose Personal Information with vendors, service providers, and consultants that need access to Personal Information in order to perform services for us, such as companies that assist us with payment processing, fraud prevention, customer service, and marketing and advertising.
  • If you submit a review or post content in a public area of our Services, we disclose this information publicly on our Services.
  • We may disclose Personal Information if we believe that disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements.
  • We may disclose Personal Information if we believe that your actions are inconsistent with our Terms of Service or other user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of HorizonIQ, our users, the public, or others.
  • We disclose Personal Information with our lawyers and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.
  • We may disclose Personal Information in connection with, or during negotiations concerning, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.
  • Personal Information is disclosed between and among HorizonIQ and our current and future parents, affiliates, and subsidiaries and other companies under common control and ownership.
  • We disclose Personal Information with your consent or at your direction.
  • We may also disclose aggregated or de-identified information that cannot reasonably be used to identify you.

Employement Applications

If you apply for a job with HorizonIQ, we may ask you to provide self-identifying information (such as veteran status, gender, and ethnicity) in conjunction with laws and regulations enforced by the Equal Employment Opportunity Commission (“EEOC”), the Office of Federal Contract Compliance Programs (“OFCCP”), and similar state and local regulatory agencies. Providing self-identifying information is voluntary, but if you do provide us with that information, we may submit it to the EEOC, the OFCCP, and similar state and local regulatory agencies for business-related purposes, including responding to information requests, fulfilling regulatory reporting requirements, and defending against employment related complaints.

Children

Our Services are not designed for children under the age of 13 and HorizonIQ does not knowingly collect any information from children younger than the age of 13. If you have reason to believe that a child has provided Personal Information to us, please contact us. If we are aware of any Personal Information that we have collected about children, we will take steps to securely remove it from our systems as soon as is practically possible.

Third-Party Websites and Content

We may provide links to third-party websites, services, plug-ins and applications that are not operated or controlled by HorizonIQ. This Policy does not apply to such third-party services, and we cannot take responsibility for the content, privacy policies, or practices of third-party services. We encourage you to review the privacy policies of any third-party services before providing any information to or through them.

Transfer of Information to the United States and Other Countries

HorizonIQ is headquartered in the United States. We do not warrant or represent that this Policy or the Services’ use of your Personal Information complies with the laws of every jurisdiction. To provide you with our Services, we and our service providers may transfer your Personal Information to, or store or access it in, jurisdictions that may not provide levels of data protection that are equivalent to those of your home jurisdiction. We will take steps to ensure that your Personal Information receives an adequate level of protection in the jurisdictions in which we process it.

Your Choices

Account Information

You may update and correct certain account information at any time by logging into your account or contacting us at contactsales@horizoniq.com.

Communications Preferences

You may opt out of receiving text messages or promotional emails from HorizonIQ by following the instructions in those communications or by managing your communication preferences via your account. If you opt out, we may still send you non-promotional emails, such as those about your account or our ongoing business relations.

Online Tracking

We do not currently recognize automated browser signals regarding tracking mechanisms, which may include “Do Not Track” instructions.

Security

HorizonIQ takes commercially reasonable steps designed to protect your Personal Information. However, no data transmission over the Internet, wireless transmission, or electronic storage of information can be guaranteed to be 100% secure. Please note that we cannot ensure or warrant the security of any information we collect. You use our Site and provide us with your information at your own risk. Our employees are required to keep information covered by this Policy confidential, unless disclosure is authorized in this Policy, or by you.

Your Rights Under State Laws

  • Shine the Light. Pursuant to California Civil Code Section 1798.83, we will not disclose your personal information to third parties for the purposes of third-party marketing to you without your prior consent.
  • Do Not Track Signals. We do not currently recognize automated browser signals regarding tracking mechanisms, which may include “Do Not Track” instructions.
  • WE DO NOT SELL OR SHARE YOUR INFORMATION. If we ever decide to “sell” or “share” personal information, as those terms are defined under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020, we will update you via this Policy and include a link entitled “Do Not Sell or Share My Personal Information,” to provide you with an opportunity to opt out of the selling or sharing of your personal information.

Your Consumer Rights

Some state laws in the United States provide consumers with additional rights with respect to their Personal Information (also known as “personal data”), as those terms are defined under those applicable state laws. Such state laws may include, but are not limited to, the California Consumer Privacy Act of 2018 (the “CCPA”) as amended by the California Privacy Rights Act of 2020, the Colorado Privacy Act (“CPA”) and the Virginia Consumer Data Protection Act (“VCDPA”). Any Personal Information we collect is collected for the commercial purpose of effectively providing our Services to you, as well as enabling you to learn more about, and benefit from, our Services. You may have the following rights under applicable state laws:

  • Access. You have the right to request that we disclose certain information to you about our collection, use and disclosure of your Personal Information over the past twelve (12) months. Any disclosures we provide will only cover the 12-month period preceding the receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable.
  • Correction. You can correct what personal data our Services collect by accessing your account directly, or by contacting us to request that we correct or rectify any personal data that you have provided to us.
  • Limit Use and Disclosure of Sensitive Personal Information. If we collect any sensitive personal information, you have the right to request that we limit the use of the sensitive personal information to that use which is necessary to perform the services or provide the goods reasonably expected by an average consumer who requests those goods or services.
  • Portability. Upon request and when possible, we can provide you with copies of your personal information. When such a request cannot be honored, we will advise you accordingly. You can then choose to exercise any other rights under this Policy.
  • Deletion. You have the right to request that we delete any of your personal information, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. Where applicable, we will ensure such changes are disclosed with trusted third parties.
  • Opt-out of Processing. You have the right to request that we do not sell your personal information, use your personal information for targeted advertising, or use your personal information for profiling. Where applicable, we will ensure such changes are disclosed with trusted third parties.
  • Non-Discrimination. If a data subject exercises his or her rights under applicable state law, including but not limited to the CCPA, CPA, and VCDPA, we shall not discriminate against that data subject by denying our goods or services, charging different prices or rates to similarly situated consumers, providing a different level or quality of our goods or services, or taking any other adverse action.
  • Exercising Your Rights. If you are a data subject that has rights under applicable state law, including but not limited to the CCPA, CPA, and VCDPA, who chooses to exercise the rights listed above, you can: (1) submit a request via email to legal@horizoniq.com, or (2) call us at 1-877-843-7627 to submit your request.

Only you, or someone legally authorized to act on your behalf, may make a request related to your Personal Information. If an authorized agent makes a request on your behalf, we may require proof that you gave the agent permission to submit the request. Upon receiving your request, we will confirm receipt of your request by sending you an email confirming receipt. To help protect your privacy and maintain security, we may take steps to verify your identity before granting you access to the personal information. In some instances, such as a request to delete personal information, we may first separately confirm that you would like for us to in fact delete your personal information before acting on your request.

We will respond to your request within forty-five (45) days. If we require more time, we will inform you of the reason and extension period in writing.

In some cases our ability to uphold these rights for you may depend upon our obligations to process personal information for security, safety, fraud prevention reasons, compliance with regulatory or legal requirements, or because processing is necessary to deliver the services you have requested. Where this is the case, we will inform you of specific details in response to your request.

Disclosure of Personal Information Categories

In the preceding 12 months, we have collected certain categories of Personal Information. For details about the precise data points we collect and the categories of sources of such collection, please see the “Information We Collect” section above. We collect Personal Information for the business and commercial purposes described in the “Use of Information” section above. Additional Disclosures for Individuals in Europe

Under the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, or “GDPR”), and the United Kingdom’s Data Protection Act 2018, (“UK GDPR” and together with GDPR heretofore collectively referred to as “GDPR”) individuals in the EU and UK are afforded specific rights with respect to their Personal Information, or “personal data” as defined under the GDPR.

For the purposes of this Policy, HorizonIQ operates as a data controller. Any personal data we collect from you is processed in the United States and under the terms of this Policy.

Any personal data we collect from you is processed in the legitimate interest of our business and providing our Services to you as the lawful means of such processing. You may always withdraw your consent to our use of your personal data as described below. We will only retain your personal data for the time necessary to provide you the information and services to which you have consented, to comply with the law and in accordance with your rights below.

  • Automated Processing and Decision-making. You may email us at legal@horizoniq.com to request that we stop using your personal data for automated processing, such as profiling. In your email, please explain how you wish us to restrict automated processing of your personal data. When such restrictions are not possible, we will advise you accordingly. You can then choose to exercise any other rights under this Policy, to include withdrawing your consent to the processing of your personal data.
  • Correction or Rectification. You can correct what personal data we have collected from you by accessing your account directly, or by emailing us at legal@horizoniq.com to request that we correct or rectify any personal data that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause information to be incorrect. Where applicable, we will ensure such changes are shared with trusted third parties.
  • Restrict Processing. When applicable, you may restrict the processing of your personal data by submitting a request via email to legal@horizoniq.com. In your email, please explain how you wish us to restrict processing of your personal data. When such restrictions are not possible, we will advise you accordingly. You can then choose to exercise any other rights under this Policy, to include withdrawing your consent to the processing of your personal data. Where applicable, we will ensure such changes are shared with trusted third parties.
  • Object to Processing. When applicable, you have the right to object to the processing of your personal data by submitting a request via email to legal@horizoniq.com. When such objections are not possible, we will advise you accordingly. You can then choose to exercise any other rights under this Policy, to include withdrawing your consent to the processing of your personal data. Where applicable, we will ensure such changes are shared with trusted third parties.
  • Portability. Upon request and when possible, we can provide you with copies of your personal data. You may submit a request via email to legal@horizoniq.com. When such a request cannot be honored, we will advise you accordingly. You can then choose to exercise any other rights under this Policy, to include withdrawing your consent. Where applicable, we will ensure such changes are shared with any trusted third parties.
  • Withdraw Consent. At any time, you may withdraw your consent to our processing of your personal data through the Services by notifying us via email at legal@horizoniq.com. Using the same email address associated with your account, simply type the words “WITHDRAW CONSENT” in the subject line of your email. Upon receipt of such a withdrawal of consent, we will confirm receipt and proceed to stop processing your personal data. Where applicable, we will ensure such changes are shared with trusted third parties.
  • Erasure. If you should wish to cease use of our Services and have your personal data deleted from our Services, then you may submit a request by emailing us at legal@horizoniq.com. Upon receipt of such a request for erasure, we will confirm receipt and will confirm once your personal data has been deleted. Where applicable, we will ensure such changes are shared with trusted third parties.

If you wish to raise a complaint on how we have handled your personal data, you can contact us as described below. If you reside in a European Union member state, you may also lodge a complaint with the supervisory authority in your country.

Changes to this Policy

HorizonIQ reserves the right to change this Policy and will notify you of material changes by posting a notice and the new Privacy Policy on the Site. We may also provide notice to you in other ways in our discretion, such as through contact information you have provided. Any changes will be effective immediately upon the posting of the revised Privacy Policy. However, we will not make material changes to how we use your Personal Information, unless you consent to the new or revised policy or generally to such uses.
